Cancer, Malignant Neoplastic Disease: Social Security Disability

 

The Social Security Administration separates disabilities due to Malignant Neoplastic Diseases into these twenty-seven categories:

If you have been or will be unable to work for at least twelve consecutive months due to cancer, you may be eligible for Social Security Disability Insurance (SSDI) benefits.   • Inoperable or unresectable
  • Persistent disease following initial multimodal antineoplastic therapy
  • Recurrent disease following initial antineoplatic therapy except local vocal cord recurrence
  • Metastases beyond the regional lymph nodes
  • Claimants with soft tissue tumors in the head and neck are considered disabled for at least twelve months from the date of the initial diagnosis.

Skin

  • Sarcoma or carcinoma with metastases to or beyond the regional lymph nodes
  • Melanoma with one of the following
    • Recurrent after wide excision (except an additional primary melanoma at a different site, which is not considered to be recurrent disease)
    • Palpable nodal metastases or metastases to adjacent skin (satellite lesions) or elsewhere

Soft Tissue Sarcoma

  • Regional or distant metastases
  • Persistent or recurrent following initial antineoplastic therapy

Lymphoma

Claimants submitting Lymphoma applications for Social Security Disability Insurance benefits are typically approved when their condition includes one of the following
symptoms:

  • Non-Hodgkin’s lymphoma with one of the following:
    • Low grade or indolent lymphoma requiring initiation of more than one antineoplastic treatment regimen with in a twelve month consecutive period
    • Intermediate or high grade lymphoma persistent or recurrent following initial antineoplastic
  • Hodgkin’s disease with failure to achieve clinically complete remission or recurrent disease within twelve months of completing initial antineoplastic therapy
  • Bone marrow or stem cell transplantation. Beneficiaries are considered disabled for at least twelve months from the date of the initial transplant

Leukemia

Claimants applying for Social Security Disability Insurance benefits are typically approved when their Leukemia symptoms include one of the following:

  • Acute Leukemia (including T-cell lymphoblastic lymphoma). Beneficiaries are considered disabled for at least 24 months from the date of initial diagnosis or relapse. Beneficiaries are also considered disabled for at least 12 months from the date of bone marrow or stem cell transplantation.
  • Chronic Myelogenous Leukemia with one of the following:
    • Accelerated or blast phase. Beneficiaries are considered disabled for at least 24 months from the date of initial diagnosis or relapse and at least twelve months from the date of bone marrow or stem cell transplantation.
    • Chronic Phase including one of the following:
      • Progressive disease following initial antineoplastic therapy
      • Beneficiaries are considered under disability for at least twelve months from the date of bone marrow or stem cell transplantation

Multiple Myeloma

  • Failure to respond or progressive disease following initial antineoplastic therapy
  • Bone marrow or stem cell transplantation. Beneficiaries are considered disabled for at least twelve months from the date of the transplantation.

  • Anaplastic (undifferentiated) carcinoma

Breast

  • Central nervous system neoplasms (brain and spinal cord) including one of the following:
    • Any central nervous system neoplasm progressive or recurrent following initial antineoplastic therapy
    • Highly malignant tumors, as in Grades III and IV astrocytomas, ependymoblastoma, glioblastoma multiforme, medulloblastoma or other primitive meuroectodermal tumors (PNETs) with documented metastases, diffuse intrinsic brain stem gliomas or primary sarcomas.
  • Peripheral nerve or spinal root neoplasm including one of the following:
    • Progressive or recurrent following initial antineoplastic therapy
    • Metastatic

Lungs

  • Adenocarcinoma that is inoperable, unresectable, or recurrent
  • Metastases beyond the regional lymph nodes
  • Swuamous cell carcinoma of the anus, recurrent after surgery

Cancers of the Female Genital Tract

  • Ureters (corpus) including at least one of the following:
    • Persistent or recurrent following initial antineoplastic therapy

  • Uterine cervix including at least one of the following:
    • Persistent or recurrent following initial antineoplastic therapy
    • Extending to the pelvic wall, lower portion of the vagina, or adjacent or distant organs
  • Vulva including at least one of the following:
    • Invading adjoining organs
    • Metastases to or beyond the regional lymph nodes
    • Persistent or recurrent following initial antineoplastic therapy
  • Fallopian tubes including at least one of the following:
    • Extending to the serosa or beyond
    • Persistent or recurrent following initial antineoplastic therapy
  • Ovaries including at least one of the following:
    • All tumors except germ-cell tumors with at least one of the following:
      • Metastases to or beyond the regional lymph nodes
      • Tumor extension beyond the pelvis
      • Ruptured ovarian capsule, tumor on the serosal surface of the ovary, ascites with malignant cells, or positive peritoneal washings
      • Recurrent following initial antineoplastic therapy
    • Germ-cell tumors that are progressive or recurrent following initial antineoplastic therapy

Malignant Neoplastic Diseases treated by Bone Marrow or Stem Cell Transplantation

Claimants with Malignant Neoplastic Diseases treated by Bone Marrow or Stem Cell Transplantation are typically approved for Social Security Disability Insurance benefits when their condition includes at least one of the following:

  • Allogeneic Transplantation
  • Autologous Transplantation

    Comment I have not worked since Aug. of 2007 when I was diagnosed with breast cancer, and I was just recently rediagnosed with breast cancer Oct. 2010. I saw this ad of tv for Freedom Disability and was wondering if I would be able to possibly receive these type of benefits. Sincerely,

    I am a 61 year old female who has not worked in years. I am married and would get social security from my husband’s records. I did, however, work off the books babysitting. I was wondering if I could get the disability pay due to the fact I have GBM IV.

      If you have worked 5 out of the last 10 years and paid FICA taxes, you may be eligible for Social Security Disability (SSDI). Also, the only way you would be eligible from your husbands credits is if he was deceased. I recommend calling the Social Security Administration and speaking with them about this. Good luck.
